It is important that you read and understand these Terms and Conditions, particularly paragraphs about Disney's legal responsibility to you such as paragraph 7. If you do not understand these Terms and Conditions, you should seek help to understand them.
To be eligible to enter the Disney Destinations Mickey’s Not-So-Scary Halloween Year 2 – Familiarisation Competition (the “Competition”), you must, at the time of submitting an Entry, be employed by a registered travel agency that is operating in Australia or New Zealand with a valid IATA, TIDS, CLIA or other valid travel agency registration number. Both retail and wholesale agents are eligible to enter. Entrants must have also sold, through their position as a travel agent, a Disney theme Park entry ticket, or accommodation or booked a cruise through an Australian or New Zealand wholesaler to a Disney Destination (as defined in paragraph 1(d) below) between 5 June 2017 and 24 September 2017 (the “Sale Period”) to a customer and retain all booking details in relation to the sale including, but not limited to:
start and end dates of the trip booked;
the wholesale reservation confirmation number relating to the booking;
the number of nights of accommodation sold to a Disney Destination;
details of which airline carrier the booking was made under, including a reservation confirmation number if the airline carrier is Virgin Airlines or Delta Air Lines®;
the number of Disney Destination tickets and duration of passes sold; and
the details of the customer for whom you booked the trip to a Disney Destination for, subject to relevant privacy laws and policies.
Entrants must also fill in the registration form and create an online account at www.wheredreamscometrue.com.au (the “Website”). Upon completion of the registration process, entrants will be provided with a username and password to be used to log into their account in order to log their sales details in accordance with Clause C. To avoid doubt, entrants who have previously registered for the service in past years will be required to create a new registration.
To enter the Competition, entrants must then go to the Website and click through to the Competition page. There, entrants must sign into their account and provide the following details in relation to each separate booking made by them via an Australia or New Zealand wholesaler during the Sales Period to a Disney Destination (as defined in paragraph 1(d) below):
start and end dates of the trip booked;
the wholesale reservation confirmation number relating to the booking;
the number of nights of accommodation sold to a Disney Destination;
the number of Disney Destination tickets and duration of passes sold;
if the airline carrier is Delta Air Lines or Virgin Australia:

Record Locator/PNR: (the flight confirmation number)
Date of Departure
Date of Booking
(collectively, the “Entry”).
An eligible “Disney Destination” includes either one of the following destinations:
Disneyland Resort in Anaheim, California;
Walt Disney World Resort in Orlando, Florida;
Hong Kong Disneyland Resort;
Disney Cruise Line;
Aulani, A Disney Resort & Spa in Hawaii; and
To avoid doubt, Tokyo and Shanghai destinations are expressly excluded
Points will be awarded based on the below criteria:
One (1) point per adult or child Disney Park Entry Ticket sold to a Disney Park & Resort globally booked through an Australian or New Zealand wholesaler
One (1) point per adult or child Return Airfare sold flying Virgin Australia or Delta Air Lines to the USA ex Australia or New Zealand booked through an Australian or New Zealand wholesaler or via your GDS.
Three (3) points per Disney hotel or cruise reservation made on Disney Cruise Line, Aulani, A Disney Resort & Spa in Hawaii, or any official Disney Resort Hotel at either the Disneyland Resort in California, the Walt Disney World Resort in Florida, Hong Kong Disneyland Resort or Disneyland Paris booked through your Australian or New Zealand wholesaler.
PLUS ONE (1) BONUS POINT will be awarded for any three (3) day or longer adult or child Disney Park Entry Ticket sold to the Disneyland Resort in California, the Walt Disney World Resort in Florida, or Disneyland Paris booked through your Australian or New Zealand wholesaler.
A maximum of nine (9) points will be awarded for any group reservation of ten (10) guests or more, irrespective of the number of booking numbers or airline reservation numbers provided.
A maximum of nine (9) points will be awarded for any single Disney or Virgin Australia or Delta Air Lines reservation logged irrespective of the number of guests travelling. All infant bookings for children 2 years of age and under are excluded.
Reservations made for personal travel are exempt.
Agents found to be pooling bookings within teams or discounting packages below the recommended sales price may be disqualified from the competition, to be determined at Disney’s sole discretion.
During the Competition Period, entrants can log into their account and submit an Entry in relation to each new booking made during the Sales Period however the details of any one booking can only be submitted once. In the event that an entrant submits any false information in relation to a booking or submits an Entry in relation to a booking that they have already logged, or submits a booking that does not qualify, then Disney reserves the right to either invalidate the Entry or disqualify the entrant.
Any eligible booking cancelled between 5 June 2017 and the Selection Date (as defined in paragraph 1(j) below) will be deemed invalid.
Entry is open from Monday 5 June 2017 at 12:01am (AEST) and closes on Sunday 24 September 2017 at 11:59pm (AEST) (the “Competition Period”). Entry can only be made during the Competition Period. Only bookings made to a Disney Destination, pursuant to Clause 1 c), during the Sales Period are eligible for entry. The Competition will be decided at 11:00AM (AEST) on Friday 29 September 2017 (the “Selection Date”).
It will be a condition of accepting the Prize that the Winner must be able and willing to participate in the Prize, which will involve overseas travel, between Thursday 26 October 2017 and Friday 3 November 2017 (subject to any changes advised by Disney in its sole discretion). The inability to travel on these dates will result in the winner forfeiting their Prize and the next eligible entrant being selected as a prize winner in their place. This confirmation must be provided at the time of accepting the prize under the conditions set forth in Clause 4.
Each entrant is only eligible to win one (1) Prize.
Entry into the Competition is free (except for any normal internet connection charges that may apply, which will remain the responsibility of each entrant).
Eligible entrants warrant to not engage in sales practices that are in any way related to this Competition which would result in a breach of the travel agent’s requirement to adhere with all laws, regulations and industry codes including, without limitation, requirements to disclose fees, commissions or other incentives.
The promoter of this Competition is The Walt Disney Company (Australia) Pty Limited (ACN 054 610 025) (“Disney”) of Level 3, 68 York St, Sydney, NSW, 2000, Australia.
All prize draws will take place at the offices of Disney.
To be eligible to enter the Competition:
you must be a permanent resident of Australia or New Zealand and be over 18 years of age;
you must be employed by a registered travel agency, that has a valid IATA or TIDS, CLIA or other valid travel agency registration number, operating in Australia or New Zealand;
you must show proof of employment within the travel trade industry valid up to and including 10 November 2017; and
neither you nor anyone in your immediate family may be an employee of Disney or its related entities (including ESPN and Maker), affiliated with Disney or connected to the Competition in any way.
Disney may disqualify you if:
either or both of you or your Entry does not meet any one or more of the requirements set out in these Terms and Conditions;
your Entry includes any objectionable material or infringes the rights (including intellectual property rights) of any third party; or
you tamper in any way with the operation of the Competition.
Your Entry must be complete, in English and legible.
If for any reason this Competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, unforeseen legal or commercial circumstances or any other causes beyond the control of Disney which corrupt or affect the administration security, fairness, integrity, or proper conduct of this Competition, Disney reserves the right in its sole discretion, to cancel, terminate, modify, delay or suspend the Competition.
The Competition is a game of skill. Chance plays no part in determining the winner.
Disney will appoint judges for the Competition (the “Judges”).
The winner selection will take place on the Selection Date. The Judges will determine the entrants who have accumulated the highest number of points accumulated during the Sale Period and logged during the Competition Period from all valid Entries into the Competition.
The seven (7) entrants who have recorded the highest total number of points (collated from nights booked plus tickets sold to a Disney Destination plus eligible Delta Air Lines® and Virgin Australia seats sold for a trip to a Disney Destination) during the Entry Period in accordance with Clause 1, will be awarded as the Competition prize winners (each a “Winner”). For the avoidance of doubt, seven (7) Winners will be selected in total. Three (3) additional Winners will be selected at random during the competition period.
Where there is a tie for eighth place, Disney will conduct a further game of skill competition to determine the eligible Winner from those entrants who have the same number of points.
The Judges’ decisions are final and no correspondence will be entered into.
Any eligible bookings made to a Disney Destination that were not logged as a part of an Entry during the Entry Period will not be valid.
The Winners will be notified by phone or email within five (5) days of the Selection Date (see paragraph 1(j)). All reasonable attempts will be made to contact the Winners. The names of the Winners will also be displayed on the Competition website.
Due to the nature of the Prize, the Prize must be claimed by close of business on Friday 6 October 2017 being eight (8) days from the Selection Date. If for whatever reason any Prize is not claimed by this date, an unclaimed prize selection will be carried out on Monday 9 October 2017 at 12:00PM (AEST).
If any proposed selection date falls on a public holiday in New South Wales, that selection will be conducted on the following business day.
If any person first chosen as a Winner is found to be ineligible, they will be disqualified another entrant will be selected as a replacement Winner.
There will be ten (10) prizes (each a “Prize”) to be won during the course of the Competition. Each Prize will consist of:
A guided trip for one (1) adult aged 18 years or over to Walt Disney World Resort in Florida, including:
return economy flights from Sydney, Australia to Orlando, USA for (1) adult valued at a maximum amount of AU$1,650;
six (6) nights’ accommodation at a hotel of the Walt Disney World Resort for one (1) adult (twin share) including return transfers from Orlando Airport to Walt Disney World Resort valued at a maximum amount of AU$1,175 RRP;
one (1) x five (5) day Walt Disney World Resort Magic Your Way Ticket with Park Hopper Plus Option for one (1) adult valued at a maximum amount of AU$630.00 RRP;
one (1) x Entry Ticket to Mickey's Not-So-Scary Halloween Party at Magic Kingdom Park for one (1) adult valued at AU $131 RRP; and
some meals and beverages during the itinerary, valued at a maximum amount of AU$450.00.
Winners must be able and willing to leave Sydney, Australia on Thursday 26 October 2017 and return from Orlando, USA to Sydney, Australia on Friday 3 November 2017 (subject to any changes advised by Disney in its sole discretion). If a Winner selected is unable to travel on these dates and at the times designated by Disney, then that Winner will forfeit their rights to the Prize and, subject to these terms and conditions, an alternative winner will be selected.
Transfers for the Winners to Sydney for the departing flight will not be provided. Each Winner must make their own arrangements to Sydney Airport on the date of departure.
To avoid doubt, the prize requires each Winner’s involvement and participation in a tour. Free time will be designated subject to timetable of scheduled activities.
Each prize is valued at up to $4,036. The total Competition prize pool is valued at up to AU$40,360.
The Prize values are based upon the recommended retail prices (inclusive of GST). Disney does not accept any responsibility for a change in Prize value.
An airfare tax of approximately $250 will be payable by each Winner as a condition of accepting the Prize.
If you are a Winner:
You may not transfer the Prize to anyone or ask for any alternative Prize (including cash).
Disney may replace the Prize with another prize of equal value in the unlikely event that the Prize becomes unavailable.
If you are not able to take the Prize as stated, you will forfeit the Prize and no payment or compensation will be made in lieu.
Once the Prize has left the premises of Disney, responsibility for any damage, delay or loss to the Prize during transit will pass to you.
Disney may ask you to provide proof of your age, identity and residency, and to sign any required documentation including release forms as a condition of claiming the Prize.
You are responsible for all expenses and taxes connected to your participation in the Competition and not included in the Prize.
If requested by Disney, the Winner may be required and must agree to be filmed during the presentation of the Prize. The Winner hereby grants to Disney the right to issue, and authorise others to issue, publicity concerning the Winner, and the right to use Winner’s name (including any professional name or sobriquet adopted by Winner), likeness and biographical data in connection with the promotion of the Competition.
If you are the Winner of the Prize,
you must, at the very least:
be able and willing to travel between Thursday 26 October 2017 and Friday 3 November 2017 (subject to any changes advised by Disney in its sole discretion);
obtain valid visas for travel to the United States of America (if required), including completing the ESTA process;
provide Disney with proof of successful visa applications prior to departure if requested; and
have passports that are valid in the country of destination (USA) for six (6) months or more from departure.
purchase travel insurance that covers you for any additional costs incurred in the event of unforseen circumstances during your time in the USA.
Except as set out above and unless and to the extent otherwise specified, you are responsible for all expenses connected to your participation in the Prize, including without limitation meals, drinks, transfers, laundry charges, activities, incidentals, taxes, energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs.
The Prize does not include any travel insurance. It is your responsibility to purchase your own travel insurance.
You are responsible for any necessary vaccinations required for travel.
You warrant that you are in good health and that no doctor has advised you not to travel and/or participate in the prize.
You must depart on the flights provided as part of the prize and as advised by Disney. Except as specified above, you are responsible for arranging transport from your residence to Sydney airport, for flight departure. You must arrive at Sydney Airport 3 hours prior to the flight’s departure time.
Travel will be arranged by Disney, or an agency of Disney’s choice, and subject to any booking restrictions such as availability of accommodation and flights. All elements of the Prize must be taken together. Travel suppliers and accommodation are to be chosen at the discretion of Disney. Travel arrangements cannot be changed once made.
A credit card imprint or cash deposit may be required to check-in to the hotel, for all incidental charges.
Disney is not in a position to make representations as to the safety, conditions or other issues that may exist at any destination. We urge you to obtain international travel advice, available from various sources including government, local consular offices and the website of the Australian Department of Foreign Affairs and Trade.
It will be a condition of accepting the Prize that the winner and guests agree that Disney will not be liable for any personal injury or other loss or damage (whether direct or consequential loss or damage) suffered or sustained in connection with the Prize, except for any liability that cannot be excluded by law.
It will be a condition of accepting the Prize that the Winner will be required to sign a prize acceptance agreement in the form provided by Disney.
Disney accepts no responsibility for any variation in the value or make-up of the prizes or any event that occurs that is beyond Disney’s reasonable control. The Winner also acknowledge that participation in and attendance at any event (including travel and accommodation providers) may be subject to additional terms and conditions imposed by third parties. Disney does not accept any responsibility and is not liable for additional conditions imposed at any event or for the breach of those conditions by any person.
Participation in the prize may include some events where alcohol is made available. Disney or its representatives reserve the right to refuse service of alcohol to any Winner should they be deemed to be intoxicated, and to limit such Winner’s participation in certain elements of the guided tour as appropriate, having consideration for safety, damage to Disney’s reputation, and any other reasonable concerns.
Disney will own your Entry and will not return your Entry at the end of the Competition. You may keep a copy of the Entry for archiving purposes.
You agree that all of the rights (including intellectual property rights) in your Entry, including any copyright works in your Entry, belong to Disney and you hereby assign any rights you may have to Disney. This includes all copyright (present or future), other intellectual property rights and rights of ownership. You grant a perpetual worldwide license (including a right to sub-license) to Disney of all rights in your Entry pending completion of this assignment.
You agree to do all things necessary (which may include signing documents) to transfer these rights to Disney.
You consent to Disney doing or omitting to do anything that infringes your moral rights in your Entry. Moral rights are your inherent rights in your Entry as the author and/or performer in the Entry and comprise the rights:
to be attributed as the author of the Entry;
not to have your authorship of the Entry falsely attributed; and
of integrity of authorship and/or performance.
Disney may record, reproduce, publish, adapt, communicate or otherwise use the entrants’ and/or Winners’ performances, names, voices, and likeness during participation in the Prize or otherwise, for the purposes of creating or producing any television program or other audio, visual and/or audio-visual material and for advertising and publicity purposes in any media in perpetuity.
Disney is not liable, and you release Disney from liability, for any loss or damage that you may suffer from your participation in the Competition, including participation in any Prize, including (without limitation) if:
the Competition is cancelled, modified, suspended or delayed, including under paragraph 3d); or
Disney does not receive your Entry within the Competition Period for any reason.
The Competition and Consumer Act 2010 (Cth) as well as other laws in Australia may imply certain conditions, warranties and undertakings, and give you other legal rights. If they apply, they cannot be modified or excluded by any contract. You may consider seeking legal advice as to whether they apply to you.
Nothing in these Terms and Conditions generally affects your rights under Australian consumer law (as contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth) and equivalent State and Territory fair trading legislation) regarding consumer guarantees to the extent that such consumer guarantees cannot be excluded by law. Other than these consumer guarantees, and subject to paragraph 7b), Disney makes no warranties about any prizes offered as a part of the Competition, including warranties as to the quality, merchantability or fitness for purpose of such prizes.
You agree to indemnify Disney against all liabilities suffered or sustained by Disney arising from any claim by a third party that your Entry infringes the rights (including intellectual property rights) of any third party.
You represent and warrant that you have all of the rights necessary to effect the transfer of rights to Disney under paragraph 6.
Disney will collect your personal information (such as your name and biographical data) as part of the Competition and may use this information anywhere in the world for the purposes of administering the Competition, and other purposes for which we obtain your express consent. Where you have expressly consented, your personal information may be provided to Disney affiliates, including overseas affiliates for future promotional, marketing and publicity purposes without notice and without any fee being paid unless otherwise advised by you.
Unless expressly stated in these Terms and Conditions, your participation in the Competition does not entitle you to use any of Disney's intellectual property rights (including any Disney trade mark or copyright) for any purpose.
You may not disclose your Entry to anyone other than Disney. You may only use your Entry to participate in the Competition. You may keep any copy of your Entry for your personal records.
These Terms and Conditions are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of courts exercising jurisdiction there, and waive any right to claim that those courts are an inconvenient forum.
Any provision (or part thereof) of these Terms and Conditions that is prohibited or unenforceable in any jurisdiction is ineffective as to that jurisdiction to the extent of the prohibition or unenforceability. That does not invalidate the remaining provisions (or parts thereof) of these Terms and Conditions nor affect the validity or enforceability of that provision (or part thereof) in any other jurisdiction.
These Terms and Conditions contain the entire agreement between you and Disney with respect to the Competition. They set out the only conduct that you have relied on and supersede all earlier conduct and prior agreements and understandings between you and Disney in connection with the Competition.
